These Terms of Service ("Terms") govern your use of the BatteryWiz mobile and desktop application (the "App") and the website at batterywiz.app (the "Website"), operated by BatteryWiz ("we", "our", "us"). By accessing or using the App or Website, you agree to be bound by these Terms. If you do not agree, please do not use them.
1. Description of Service
BatteryWiz is a home energy optimisation application that uses mathematical optimisation to schedule battery charging and discharging. The App aims to help you minimise electricity costs and maximise solar self-consumption. When configured, the App can send control commands to compatible inverters via third-party cloud APIs.
The Website provides information about the App, including documentation, blog content, guides, and support.
2. Eligibility
The App and Website are intended for adults. By using them, you confirm that you are of legal age to enter into a binding agreement in your jurisdiction.
3. Free Trial, Subscriptions & Purchases
The App includes a 60-day free trial with full access to all features. After the trial period, continued access to premium features requires an active subscription (monthly or yearly) or a one-time lifetime purchase.
- All transactions are processed by Google Play (Android) or the Microsoft Store (Windows) and are subject to their respective terms and refund policies.
- We do not have access to your payment or billing information.
- Subscriptions renew automatically unless cancelled before the end of the current billing period through the respective store.
4. Inverter Control & User Responsibility
When you enable automatic inverter control, the App sends commands to your inverter via third-party cloud APIs. By using this feature, you acknowledge and agree that:
- You are responsible for ensuring your equipment is compatible and correctly configured.
- Automated commands may affect your battery based on external factors beyond our control, including grid conditions, tariff changes, weather, and equipment behaviour.
- You should monitor your system regularly, particularly when first enabling automatic control.
- We are not responsible for any damage to your equipment, unexpected energy costs, or other consequences resulting from automated commands.
5. Intellectual Property
All content, design, code, and intellectual property in the App and on the Website (including text, graphics, logos, and software) are owned by or licensed to BatteryWiz and are protected by applicable copyright and intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App or Website without our prior written consent.
6. Acceptable Use
You agree not to:
- Use the App or Website for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to interfere with, compromise the integrity of, or gain unauthorised access to any part of the App, Website, or related systems.
- Reverse-engineer, decompile, or disassemble the App except where permitted by applicable law.
- Redistribute, resell, or sublicense the App or any part of it.
7. Disclaimer of Warranties
The App and Website are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the optimisation results will achieve specific cost savings. Energy markets, tariffs, weather conditions, equipment behaviour, and third-party API availability may all vary and affect outcomes.
8. Limitation of Liability
To the maximum extent permitted by applicable law, BatteryWiz and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or revenue
- Loss of data
- Equipment damage or malfunction
- Unexpected energy costs
- Interruption of service due to third-party API outages
Our total liability to you for any claim arising from or related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
9. Third-Party Services
The App integrates with third-party services that you choose to configure, such as inverter cloud platforms and solar forecast providers. These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service, and your use of them is at your own risk.
10. Termination
You may stop using the App at any time by uninstalling it. We reserve the right to suspend or terminate access to any part of the App or Website if we reasonably believe you have violated these Terms.
11. Privacy
Your use of the App and Website is also governed by our Privacy Policy, which explains how we handle your information.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the App or Website after any changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
